Privacy Policy

Your privacy is important to us.  As part of our efforts to facilitate and make your experience with the Caldwell Ballistic Chronograph App and/or the Caldwell Target Camera App (together, the “Caldwell Apps”) as user-friendly and enjoyable as possible, we may collect and use certain information you provide to us.  This Privacy Policy addresses the collection, use, and disclosure of information that Battenfeld Technologies, Inc. (“BTI”) may gather during your use of the Caldwell Apps.

Please review the entire policy to learn the types of User information BTI gathers, how BTI uses that User information, what User information is disclosed and to what third parties, and how BTI safeguards your User information.

Please also check back periodically as this Privacy Policy may change from time to time.  We will notify you of any material changes by publishing the new Privacy Policy through the Caldwell Apps.  The User information that BTI gathers is and will be subject to the Privacy Policy in effect at the time the information is gathered.  Should you have any questions or concerns at any time, please feel free to contact us.

This Privacy Policy applies only to the Caldwell Apps.  This Privacy Policy does not apply to any applications or websites managed, maintained, and/or hosted by third parties not directly affiliated with BTI that you may visit, e.g., via a link provided through the Caldwell Apps or on a website maintained by any third party.  BTI does not control the privacy policies of other applications or websites to which we may provide hyperlinks.  We encourage you to learn more about the online privacy and data security policies of third party websites directly from such third parties, as their policies may differ from ours.

PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY.  BY SUBMITTING YOUR INFORMATION TO US AND BY USING THE CALDWELL APPS, BTI WILL ASSUME THAT YOU HAVE READ, UNDERSTOOD, AND CONSENT TO THE AGREEMENT, WHICH INCLUDES THIS PRIVACY POLICY, THE TERMS AND CONDITIONS, AND ALL OTHER APPLICABLE BTI RULES AND POLICIES.  WE ALSO ASSUME THAT YOU CONSENT TO BTI’S USE OF YOUR INFORMATION AS DESCRIBED IN THE AGREEMENT.  If you do not consent, you should not access or use the Caldwell Apps.

I.                   Description of the Caldwell Apps

The Caldwell Apps refers to two apps: the Caldwell Ballistic Chronograph App and the Caldwell Target Camera App.  Certain specialized equipment may be required in order to use the Caldwell Apps. For example, the Caldwell Target Camera App is designed for use with a Caldwell Long Range Target Camera and the Caldwell Ballistic Chronograph App is designed for use with a Caldwell Ballistic Chronograph.  The Caldwell Apps function to connect with such specialized equipment to allow Users to view, store, calculate and share chronograph and target data generated by such equipment.

II.                Information BTI Collects

The chronograph/target data generated through the use of the Caldwell Apps is neither shared, accessed, or actively collected by BTI. As a User, you control what personal information, non-identifying information, and chronograph/target data is stored and/or shared through your use of the Caldwell Apps.

A.                Personal Information and Non-Identifying Information

When you use the Caldwell Apps, you may be required to input certain personally identifying information in order to use all functionalities of the Caldwell Apps.  This refers to information about you that can be used to contact or identify you (“Personal Information”).  Personal Information includes, but is not limited to, your full name, phone number, email address, home and business postal addresses, photos of you, and any other information that could be used to personally identify you.

We may also collect other information that you provide as part of the administration and personalization of your account with us that does not identify you (“Non-Identifying Information”).  Non-Identifying Information includes, but is not limited to, your zip code (on its own), gender, age, and individual preferences.  Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified.  But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your gender only or your viewing preferences).

We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide the Caldwell Apps, facilitate your ability to save and share chronograph/target data, and respond to correspondence from you.  We may also use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you.  If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications.

We may also combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other users to attempt to provide you with a better experience, to improve the quality and value of the Caldwell Apps, and to analyze and understand how the Caldwell Apps is used.

B.                 Usage Data

When you log into the Caldwell Apps, our servers automatically record information that the Mobile App sends.  The information sent automatically by the Mobile App is referred to as “Usage Data.”  This Usage Data may include information such as the manufacturer and model of your mobile device, your Internet Service Provider (ISP); your device’s Internet Protocol (“IP”) address (or other device identifier), browser type, and operating system; referring/exit pages; clickstream data; parts of the App that you visit, the time spent interacting with certain portions of the Mobile App, information you search for on the Caldwell Apps, Mobile App access times and dates; and other statistics.

Usage Data may also include geolocation data.  The Caldwell Apps may collect and use geolocation data to provide weather condition information to Users which can be added as a field and saved along with the chronograph/target data.  The Caldwell Apps will request your express permission to collect your geolocation data.  Such geolocation data is not actively collected or stored by BTI.

We may use this Usage Data for technical administration of the Caldwell Apps, including to monitor and analyze use of the Caldwell Apps, to increase the functionality and user-friendliness of the Caldwell Apps, and to better tailor the Caldwell Apps to Users’ needs.

Usage Data may be non-identifying or it may be associated with you.  Whenever we associate Usage Data with Personal Information, we will treat it as Personal Information.

III.             Collection of Information

BTI does not access or actively collect Personal Information, Non-Identifying Information, or Usage data; rather, all such information is actively submitted by the User while using the Caldwell Apps or submitted by the User to BTI when corresponding with BTI.  The Caldwell Apps provide a number of different techniques and technologies through which a User may input Personal Information, Non-Identifying Information, and Usage Data.  For example, the Caldwell Apps may use your device’s microphone and camera, forms, cookies, clear gifs, pixel tags, embedded scripts, and/or other technology used to monitor your use of the Caldwell Apps.

A.                Your Device’s Microphone and Camera

In order to use the Caldwell Apps, you will be asked to grant permission to the Caldwell Apps to access your device’s microphone and/or camera.  When a chronograph is connected to your device’s microphone jack, the Caldwell Apps may actively “listen” to audio data provided by the microphone.  When disconnected, no audio data is collected.  This microphone data is neither stored or shared by BTI.

B.                 Forms

We request certain information from you through the use of forms when you use the Caldwell Apps.  For example, Users may input certain group information, including fields and collections of velocities. This group information may be saved at the User’s discretion and the User may share this group information via email or SMS text messaging.

C.                Public Communications

Please note that if you use any bulletin board, chat room, comment posting feature, or other public communication service, forum, or feature that may be offered through the Caldwell Apps, or post any information available for viewing by other Users, such as by choosing to email your content or chronograph/camera data to a third party, any of the information that you share will be visible to other Users.  In addition, if you choose to share your chronograph or target data via email with a third party, that third party will be able to see your data and your contact information.  The information that you make available can be read, used, and collected by other Users to send you unsolicited messages outside of the Caldwell Apps.  BTI is not responsible for the manner in which the chronograph/camera data or Personal Information that you decide to share will be used by other Users.

IV.             Use and Sharing of Information by BTI

User’s chronograph/target data is not shared by BTI.  The User information that is submitted by Users to BTI may be added to our databases and used for business purposes, including for marketing and promotional purposes, for a statistical analysis of Users’ behavior, for product development, for content improvement, or to customize the content and layout of the Caldwell Apps.  In addition, BTI will, on occasion, send emails to you about the Caldwell Apps or third-party products.

BTI’s policy is not to share the User information it collects with third parties other than as specified below, or where a User expressly consents to our sharing of certain information with a third party.  We may share User information with third parties under the following circumstances:

A.                Connecting Users

The Caldwell Apps uses certain information provided by Users to connect Users with each other.  The Caldwell Apps provide functionality to allow Users to email or SMS text message to other Users or third parties their selected chronograph/target data.  In addition, Users may take and store images and record video on their mobile device through the Caldwell Apps if they choose to do so, and Users are able to share such pictures through the Caldwell Apps via email or SMS.

B.                 Other Business Partners and Vendors

We work closely with certain business partners and vendors and we may provide User information to our business partners and vendors so that they can offer or provide services to you.  For example, we may provide User information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you.

C.                Promotions

From time to time, we may offer promotions through the Caldwell Apps that require a separate registration.  By participating in such a promotion, you agree to the official rules for the promotion, which may require that you provide certain information.  Information collected in connection with a promotion will be used consistently with the promotion’s official rules and this Privacy Policy.

D.                Business Transfers

As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, sale of assets, or bankruptcy.  In such transactions, information about Users generally is often a transferred business asset.  In the event that BTI itself or substantially all of BTI’s assets are acquired, information about our Users may be one of the transferred assets.

E.                 Compliance with Law and Protection of BTI and Others

We may release User information when we believe, in our sole discretion, that release is appropriate: to comply with the law, including but not limited to, in response to a subpoena served on BTI; to enforce or apply the Agreement, including the Terms and Conditions and other agreements, rules, and policies; to protect the rights, property, or safety of BTI, our Users, or others; or to prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable (including exchanging User information with other companies and organizations for fraud protection).

F.                 Aggregate Site Use Information

We may release aggregate User information (without revealing any Personal Information about you) to advertisers and other third parties in order to promote or describe use of the Caldwell Apps.

V.                BTI’s Opt-in/Opt-out Policy

By providing an email address on the Caldwell Apps, you agree that BTI may contact you in the event of a change in the BTI Agreement, including this Privacy Policy, to provide you with any service related notices, or to provide you with information about BTI events, invitations, or related educational information.

For purposes of this Privacy Policy, “opt-in” is generally defined as any affirmative action by a User to submit or receive information, as the case may be.

We currently provide the following “Opt-Out Opportunities”:

1.                  At any time, you can follow a link provided in offers, newsletters or other email messages (except for e-commerce confirmation or service notice emails) received from BTI to unsubscribe from the Service.

2.                  At any time, you can contact us through marketing@btibrands.com or the address or telephone number provided below to unsubscribe from the Service and opt-out of our right per your consent under the terms of this Privacy Policy to share your Personal Information.

Notwithstanding anything else in this Privacy Policy, please note that BTI always reserves the right to contact you in the event of a change in the BTI Agreement, including this Privacy Policy, or to provide you with any Service related notices.

California Users. In addition to the ability to utilize the Opt-Out Opportunities described above, California Users may have the right to request certain disclosure information annually from BTI.  Such disclosure requests should be directed to: Battenfeld Technologies Inc.

VI.             Third Party Service Providers, Links to other Sites, and Third Party Advertising

This Privacy Policy applies only to the Caldwell Apps.  This Privacy Policy does not apply to any other apps or websites managed, maintained, and/or hosted by third parties not directly affiliated with BTI that you may visit, e.g., via a link provided through the Caldwell Apps or on a website maintained by any third party.  BTI does not control the privacy policies of other websites to which we may provide hyperlinks.  We cannot be responsible for the privacy practices or the content of such non-BTI apps or websites, and we do not control the practices of any of the third party websites or service providers to whose sites we link. We encourage you to learn more about the online privacy and data security policies of third party apps or websites directly from such third parties, as their policies may differ from ours.

VII.          International Transfer

By accessing and using the Caldwell Apps, you acknowledge and agree that BTI controls and operates all parts of the Caldwell Apps from its offices in the United States of America and that the Caldwell Apps is intended for use by Users located in the United States of America.  Unless expressly stated to the contrary, BTI makes no representation that the Caldwell Apps is appropriate or will be available for use in other locations.

If you access the Caldwell Apps from outside the United States, you acknowledge and agree that your information may be transferred to and maintained on computers and servers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  Your consent to the Agreement followed by your submission of such information represents your agreement to the transfer of such information to the United States and the collection, use, and disclosure of your information in accordance with United States law and our Privacy Policy.

VIII.       Security

We are very concerned with safeguarding your information.  We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access.

Please note that no security system is impenetrable. Accordingly, we do not guarantee the security of our databases, nor that information you supply won’t be intercepted while being transmitted to us over the Internet or other network.  Any information you transmit to BTI through the Caldwell Apps, you do at your own risk.  We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting through the Caldwell Apps in the most expedient time possible and without unreasonable delay, as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

IX.             Children’s Privacy

We are committed to protecting the privacy of children.  Under the terms of the Agreement, Users must be at least thirteen (13) years of age to access and use the Caldwell Apps.  Any access to or use of the Caldwell Apps by anyone under the age of thirteen (13) is unauthorized, unlicensed, and in violation of the Agreement.  By using the Caldwell Apps, you represent and warrant that you are thirteen (13) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Agreement.  If BTI believes that you are under the age of thirteen (13) or that you are not old enough to consent to and be legally bound by the Agreement, BTI may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Caldwell Apps (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted through the Caldwell Apps.

X.                Changes to this Privacy Policy.

We encourage you to periodically review our Privacy Policy to be sure you are familiar with the most current version.

We will notify our Users when we make any significant changes to our Privacy Policy that affect the use of any Personal Information we collect. We will not make new use of any User information which BTI gathered from individual Users prior to any such significant change in our Privacy Policy without first obtaining the User’s consent for any new uses.
